Australian cases

There are always a lot of requests for sources on Australian cases, or to know how to find NSWLR. Here are some tips of sources (comment is needed on this page for further sources). You may find the IALS FLAG Foreign Law Guide a useful starting point to locate certain law reports in UK collections.

 

  • AustLii is an excellent free source for reported and unreported versions of case law and a good place to start. It is the primary source for 
  • High Court of Australia (HCA) from 1903
  • Federal Court of Australia (FCA) from 1977
  • Full Court of the Federal Court of Australia from 2002 plus much much more. 

Note: it doesn't cover the older NSWLR cases. See the databases page on Austlii for more information on coverage.

  • NSW Judiciary (previously LawLink) is an online government portal to law in New South Wales. Provides links to case reports, via CaseLaw NSW.
  • NSWLR - New South Wales Law Reports. Published in Australia on Thomson Reuters or Lexis Nexis AU. An Index of cases published in the NSWLR is available on their website. In the UK (if they are not part of your subscription to Westlaw or Lexis), they are available from:
    • the British Library (1971-) but this appears to only be in their General Reference Collection. 
    • The Institute of Advanced Legal Studies also hold them and their FLAG Foreign Law Guide allows you to search out which institutions may also hold law reports.
    • The Bodleian Law Library (1881 onwards - note that between 1900 and 1971 they are down as the State Reports (New South Wales) but appear to be part of the NSWLR series. The Bodleian operate a Doc Del service). Their Australian Law Guide is also a useful starting point.

 

Pending Federal Cases

 

  • Federal Law Search is a free source that provides selected information on cases filed in the Federal Court of Australia and in the federal law jurisdiction of the Federal Circuit Court of Australia (previously the Federal Magistrates Court). The information is real time and includes all cases that have commenced since 1 January 1984. Each case record also links to documents such as Judge's Orders and judgments.
