Old cases - sources

 

English Reports (ER) - many law reports from the 19th century and earlier were consolidated into this series, available via the Justis and Hein Online subscription services among others. 

 

For a list of which series are included within the English Reports use the Cardiff Index to Legal Abbreviations.

The English Reports can be found on CommonLii (in PDFs, 1220-1873, based on data provided by Justis), Justis, and also on Westlaw - but not in PDFs. They are browsable by volume.

Westlaw now has facsimile pdfs of judgments in the English Reports.

Cases mentioned as notes in English Reports do not appear to be available via a Westlaw or LexisLibrary search e.g. Wilmer v Horton (1781) 2 Doug 702n which appears as a long footnote to Hyde v Cogan (1781) 2 Doug 699. A search using either the party names or free text/search boxes will not find the case. A Commonlii search will not find these cases either. For such cases it is necessary to look at the hard copy unless you know the name of the case in which the footnoted case appears.
